Terms of Service

1. Acceptance of Terms

By accessing or using this website (the “Site”) or purchasing any products or services (the “Services”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, please do not use the Site.

You must be at least 19 years old (the age of majority in British Columbia) to purchase artwork.

2. Changes to the Terms

We may update or modify these Terms at any time by posting the revised version with an updated Effective Date. Continued use of the Site constitutes acceptance of the revised Terms.

3. Intellectual Property & Copyright

  • All photographs, images, videos, designs, graphics, and written content on this Site (“Content”) are the exclusive property of Mike Crane Photography and are protected by Canadian and international copyright laws.
  • Purchasing a print does not grant any reproduction, licensing, commercial, or digital use rights.
  • You may not copy, reproduce, scan, screenshot, upload, distribute, publish, sell, train AI models with, or create derivative works from any Content without explicit written permission from Mike Crane Photography.
  • Unauthorized use of copyrighted artwork may result in legal action.

4. Limited Editions & Certificates

  • Limited Editions: Unless otherwise noted, fine art prints are limited to a total edition of 25 prints worldwide across all sizes and mediums.
  • Exception – Patagonia Collection: The Patagonia Collection may follow separate editioning rules, which will be specified on the product page.
  • Artist Proofs: Artist’s Proofs (A.P.) may exist outside the numbered edition.
  • Certificates of Authenticity: Select prints may include a signed or serialized certificate.

5. Product Descriptions & Display Variations

We strive for accuracy in product descriptions. However:

  • Colors and tones may vary between screen display and final print due to monitor calibration and the nature of fine art printing.
  • Materials (paper, frames, mounts) may vary depending on supplier availability or improvements in archival quality.
    These variations are not considered defects.

6. Pricing, Taxes & Duties

  • All prices are listed in Canadian Dollars (CAD) unless stated otherwise.
  • Applicable GST, PST, or HST will be calculated based on the shipping address.
  • International customers are responsible for any customs fees, import duties, taxes, or brokerage charges.
  • Prices may change without notice. In the event of an obvious pricing error, orders may be cancelled and refunded.

7. Orders, Payment & Processing Time

  • Orders are considered an offer to purchase and may be accepted or declined at our discretion.
  • Payment is processed at checkout through our secure payment partners.
  • Because all fine art prints are made-to-order to gallery standards, we recommend allowing up to one month for production, artist inspection, preparation, and shipping.
  • In rare cases (holidays, material shortages, special sizes), production times may exceed these estimates.

8. Shipping & Delivery

  • Shipping carriers vary depending on the size, medium, framing options, and destination. Carriers may include Canada Post, couriers, or freight services.
  • Delivery timelines are estimated and not guaranteed.
  • Risk of loss transfers to you once the package is delivered to the address you provided.
  • If damage occurs in transit, contact us within 5 business days with photos of the artwork and packaging so we can assist with replacement options.

9. Returns, Exchanges & Cancellations

  • Because prints are produced on-demand, all sales are final.
  • However, we offer a 14‑day return window from the date you receive your print for store credit only.
  • Items must be in original condition and original packaging.
  • Customer is responsible for secure repackaging and return shipping unless the item arrived damaged or defective.
  • Cancellations can only be processed before production of your artwork begins.

10. Accounts & Security

If you create an account:

  • You are responsible for maintaining the confidentiality of your login information.
  • You agree to provide accurate, current information.
  • We may suspend or terminate accounts for misuse or violations of these Terms.

11. Acceptable Use

You agree not to:

  • Scrape or harvest data from the Site.
  • Access the Site using bots, crawlers, or automated tools without permission.
  • Introduce malware, attempt to breach security, or interfere with Site functionality.
  • Use any Content for training, developing, or improving AI or machine‑learning models.

12. Third‑Party Services

We may use third‑party providers for payments, print labs, or shipping. These services have their own terms and privacy practices. We are not responsible for the actions of third-party providers.

13. Privacy

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information in accordance with BC’s Personal Information Protection Act (PIPA).

14. Warranties & Disclaimers

The Site and Services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability.

15. Limitation of Liability

To the maximum extent permitted by law:

  • Mike Crane Photography is not liable for any indirect, incidental, or consequential damages, including lost profits or data.
  • Total liability for any claim will not exceed the amount you paid for the artwork in question.

16. Indemnification

You agree to indemnify and hold harmless Mike Crane Photography from any claims, losses, damages, liabilities, and expenses arising from your use of the Site or violation of these Terms.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of British Columbia and the federal laws of Canada.
You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for any disputes.

18. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including weather events, supply chain interruptions, labour disputes, or transportation failures.

19. Entire Agreement

These Terms constitute the entire agreement between you and Mike Crane Photography regarding the Site and Services.

20. Accessibility

Mike Crane Photography is committed to providing a website that is accessible to the widest possible audience. However, we do not warrant or represent that the Site will be fully accessible or compliant with any specific accessibility standards, including WCAG or similar guidelines. Users may experience temporary or unintended accessibility barriers.
