1. Acceptance of Terms By accessing or using this website (the “Site”) or purchasing any products or services (the “Services”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, please do not use the Site. You must be at least 19 years old (the age of majority in British Columbia) to purchase artwork.

2. Changes to the Terms We may update or modify these Terms at any time by posting the revised version with an updated Effective Date. Continued use of the Site constitutes acceptance of the revised Terms.

3. Intellectual Property, Copyright & Commercial Restrictions

• Absolute Ownership: All photographs, images, videos, designs, graphics, layouts, and written content displayed on this Site (“Content”) are the exclusive, unencumbered property of Mike Crane Photography and are strictly protected by Canadian and international copyright and intellectual property laws.

• Zero Commercial Rights: Purchasing a fine art print, physical product, or accessing any material on this Site grants you a physical object for personal display only. It does not grant any reproduction, licensing, commercial, merchandising, advertising, promotional, or digital use rights whatsoever.

• Prohibited Uses: You are strictly prohibited from copying, reproducing, scanning, screenshotting, downloading, vectorizing, uploading, distributing, publishing, selling, licensing, training artificial intelligence (AI) or machine-learning models with, or creating derivative works from any Content without express, explicit written permission from Mike Crane Photography.

• Enforcement: Unauthorized use, reproduction, or commercial exploitation of any copyrighted artwork or site content constitutes immediate infringement and will result in aggressive legal action and claims for statutory damages.

1. Limited Editions & Certificates Limited Editions: Unless otherwise noted, fine art prints are limited to a total edition of 25 prints worldwide across all sizes and mediums. Exception – Patagonia Collection: The Patagonia Collection may follow separate editioning rules, which will be specified on the product page. Artist Proofs: Artist’s Proofs (A.P.) may exist outside the numbered edition. Certificates of Authenticity: Select prints may include a signed or serialized certificate.

2. Product Descriptions & Display Variations We strive for accuracy in product descriptions. However: Colors and tones may vary between screen display and final print due to monitor calibration and the nature of fine art printing. Materials (paper, frames, mounts) may vary depending on supplier availability or improvements in archival quality. These variations are not considered defects.

3. Pricing, Taxes & Duties All prices are listed in Canadian Dollars (CAD) unless stated otherwise. Applicable GST, PST, or HST will be calculated based on the shipping address. International customers are solely responsible for all import duties, tariffs, customs fees, taxes, and brokerage charges associated with international shipments. We are not responsible or liable for any customs fees, import duties, or local taxes incurred upon delivery. Prices may change without notice. In the event of an obvious pricing error, orders may be cancelled and refunded.

4. Orders, Payment & Processing Time Orders are considered an offer to purchase and may be accepted or declined at our discretion. Payment is processed at checkout through our secure payment partners. Because all fine art prints are made-to-order to gallery standards, please allow up to one month for production, artist inspection, preparation, and shipping. Timelines may vary depending on print size, medium, and studio workflow. In rare cases (holidays, material shortages, special sizes), production times may exceed these estimates.

5. Shipping, Delivery & Inspection

• Shipping Rates & Fulfillment: Complimentary shipping is provided on all Canadian orders. Automated flat-rate shipping is calculated at checkout for the United States and international destinations to cover secure art transport, global freight, and transit insurance.

• Right to Adjust & Cancel: Due to the unique nature of large-format fine art logistics, we reserve the right to review orders destined for extreme remote locations or unusual multi-item outliers. At our discretion, we reserve the right to cancel orders or require additional shipping payment prior to fulfillment should actual freight costs exceed standard automated parameters.

• Shipping Carriers: Shipping is carried out using a variety of couriers, freight services, and specialized art-handling carriers depending on print size, medium (metal, rolled prints, framed work, oversized pieces), destination, and packaging requirements.

• Delivery Inspection Protocol: When your artwork arrives, please thoroughly inspect the exterior packaging and crating materials before signing the delivery receipt. If there is any visible sign of damage, ensure the driver notes it on the delivery record. We strongly recommend carefully opening and inspecting the artwork itself prior to signing off on delivery. If you discover any damage to the print, retain all original packaging materials and contact us immediately with photographic evidence so we can file the transit insurance claim and arrange a resolution.

1. Final Sale & Cancellations

• Bespoke & Final Sale: Because every museum-grade piece is custom-crafted uniquely for you upon order, all sales are final. Prints are non-refundable and cannot be returned, exchanged, or credited.

• Cancellations: Order cancellations can only be processed before production of your artwork begins. Once production has started, orders cannot be cancelled or refunded.

1. Accounts & Security If you create an account: You are responsible for maintaining the confidentiality of your login information. You agree to provide accurate, current information. We may suspend or terminate accounts for misuse or violations of these Terms.

2. Acceptable Use You agree not to: Scrape or harvest data from the Site. Access the Site using bots, crawlers, or automated tools without permission. Introduce malware, attempt to breach security, or interfere with Site functionality. Use any Content for training, developing, or improving AI or machine‑learning models.

3. Third‑Party Services We may use third‑party providers for payments, print labs, or shipping. These services have their own terms and privacy practices. We are not responsible for the actions of third-party providers.

4. Privacy Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information in accordance with BC’s Personal Information Protection Act (PIPA).

5. Warranties & Disclaimers The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability.

6. Limitation of Liability To the maximum extent permitted by law: Mike Crane Photography is not liable for any indirect, incidental, or consequential damages, including lost profits or data. Total liability for any claim will not exceed the amount you paid for the artwork in question.

7. Indemnification You agree to indemnify and hold harmless Mike Crane Photography from any claims, losses, damages, liabilities, and expenses arising from your use of the Site or violation of these Terms.

8. Governing Law & Jurisdiction These Terms are governed by the laws of British Columbia and the federal laws of Canada. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for any disputes.

9. Force Majeure We are not liable for delays or failures caused by events beyond our reasonable control, including weather events, supply chain interruptions, labour disputes, or transportation failures.

10. Entire Agreement These Terms constitute the entire agreement between you and Mike Crane Photography regarding the Site and Services.

11. Accessibility Mike Crane Photography is committed to providing a website that is accessible to the widest possible audience. However, we do not warrant or represent that the Site will be fully accessible or compliant with any specific accessibility standards, including WCAG or similar guidelines. Users may experience temporary or unintended accessibility barriers. If you encounter any accessibility issues or require materials in an alternative format, please contact us at info@mikecranephotography.com, and we will make reasonable efforts to accommodate your request in a timely manner. Nothing in this clause is intended to limit any rights available under applicable accessibility or human‑rights laws.
